Terms of Service

These Terms govern your use of FishTale, a comment-free social network for anglers operated by EGO HERO LTD, a New Zealand company based in Whangarei. By creating an account or using FishTale, you agree to these Terms.

1. Who can use FishTale

  • You must be at least 13 years old. If you're under 16, you confirm that a parent or guardian has agreed to these Terms on your behalf. We rely on your declaration of age — we don't verify it separately.
  • You agree to provide accurate signup information.
  • One human, one account. Bots, impersonation, and multi-accounting for moderation evasion are not allowed.

2. Your content

You keep ownership of every catch, photo, video, and bit of text you post. By posting, you grant EGO HERO LTD a worldwide, non-exclusive, royalty-free licence to host, display, resize, transcode, back up, and distribute your content for the purpose of running and promoting FishTale.

This licence ends when you delete the content or your account. After deletion, your content is removed from live systems within 30 days and purged from encrypted backups within 90 days, in line with the retention schedule in our Privacy Policy. We may also keep moderation records for up to 12 months after account deletion so we can investigate appeals and detect repeat offenders.

You confirm that the content you post is yours and doesn't breach anyone else's rights.

3. Rules of the road

Use of FishTale is subject to our Community Guidelines and Acceptable Use Policy. Together they describe what's allowed and what gets your post flagged, hidden, or removed.

4. Pro subscriptions

Statutory rights come first.Where you use FishTale as a consumer in New Zealand, nothing in this section limits your rights under the Consumer Guarantees Act 1993 (CGA) or the Fair Trading Act 1986 (FTA). If a guarantee under the CGA is not met, you are entitled to the statutory remedies in that Act, including refund where applicable. For users in the EU/UK/EEA, your equivalent statutory consumer rights also apply. The terms below operate subject to those rights.

  • Pro is a paid subscription billed through Stripe in New Zealand Dollars. The current price and trial terms are shown on the checkout page before you confirm.
  • Free trial:we offer a 7-day free trial of Pro to eligible new accounts. You can cancel during the trial from the in-app billing portal and you won't be charged. If you don't cancel, the subscription auto-renews at the price shown at checkout.
  • You may cancel at any time from the in-app billing portal. Cancellation takes effect at the end of your current billing period. We do not refund unused portions of a billing period except where required by law (including the CGA / FTA / statutory consumer rights described above).
  • EU/UK 14-day right of withdrawal:consumers in the EU, UK, and EEA have a 14-day right to withdraw from a digital services contract. Where you start using Pro during the 14-day window, you accept that the service is being supplied to you and waive the right of withdrawal for content actually consumed during that period, in line with EU Directive 2011/83/EU Article 16(m).
  • You retain Pro features for the period you've paid for. After it ends your account reverts to the free tier without losing your data.

5. Moderation, flagging, and suspension

FishTale uses automated content moderation at upload time (Google Cloud Vision AI for image and video frame analysis, plus internal heuristics) combined with human review for flagged posts. By posting on FishTale you accept that these automated checks happen on every upload.

Three-strike auto-suspension.If three of your catches are hidden by moderation (either automatically at upload or after community reports), your account is automatically suspended pending review. While suspended you can still sign in and read content but you can't post, react, or follow. The graduated ladder of consequences is described in section 8 of our Community Guidelines.

You have the right to request a human review of any automated decision that significantly affects you. Email support@fishtale.app. EU/UK users have this right under GDPR Article 22 as well; we extend it to all users globally.

6. Disclaimers

FishTale is provided on an "as is" and "as available" basis. We try hard to keep it accurate and online, but we don't guarantee that catch data, weights, species, locations, weather information, or any other user-generated content is correct. See our Disclaimer for the detail.

Business users.Where you acquire FishTale services for the purposes of a business (s 43 CGA / s 5D FTA), and where it is fair and reasonable, the protections of the CGA and FTA are contracted out of to the maximum extent permitted by law. Consumers continue to receive the full benefit of those Acts as described in section 4.

7. Limitation of liability

To the maximum extent permitted by law, EGO HERO LTD is not liable for any indirect, incidental, or consequential loss arising from your use of FishTale, including lost data, lost catches, missed fish, missed PBs, or losses caused by inaccurate information posted by other users. Our total aggregate liability to you in any 12-month period is limited to the greater of NZ$100 or the amount you paid us in that period. Nothing in this section limits liability we cannot lawfully exclude, including liability for death, personal injury caused by negligence, fraud, or rights you have as a consumer that cannot be waived.

8. Termination and account deletion

You can delete your account at any time from your profile settings. Deletion triggers the retention schedule in our Privacy Policy.

We can suspend or terminate your account in two situations:

  • Non-egregious breachesof these Terms, the Guidelines, or the Acceptable Use Policy: we will normally give you at least 7 days' notice by in-app message or email, with reasons and an opportunity to put things right or respond.
  • Egregious or repeated breaches— illegal acts, cruelty, hate speech, doxxing, fraud, threats to other users, the three-strike auto-suspension trigger described in section 5, or breaches that materially harm other users or the platform: we may suspend or terminate immediately and explain afterwards. You can still request human review by emailing support@fishtale.app.

On termination, your right to use FishTale ends. Our right to use your content under section 2 ends at the same time, subject to the retention periods in the Privacy Policy.

9. Changes to these Terms

We may update these Terms as FishTale evolves. We'll surface material changes in-app or by email before they take effect. Continued use after the effective date counts as acceptance of the new Terms. For paid Pro users, where a change is materially adverse to you, we will give you the option to cancel and receive a pro-rata refund of any prepaid amount covering the period after the change takes effect.

10. Governing law and disputes

These Terms are governed by the laws of New Zealand. Any dispute that can't be resolved by emailing support@fishtale.appwill be brought before the New Zealand courts, where you and EGO HERO LTD submit to the non-exclusive jurisdiction of those courts. Nothing in this section prevents a consumer from bringing a claim in the courts of the country where they live where their local law gives them that right.
